These terms cover the Mementote app, mementote.co and related services. By using them you agree to these terms.

1. Who can use it

You must be at least 13, or the age of digital consent where you live. If you act for an organization, you confirm you may accept these terms for it.

2. Your account

You sign in with passkeys. Keep your devices secure; you’re responsible for activity under your account.

3. What you leave

You own what you record. You give us a limited licence to store, process and play it back in its place for the audience you chose, only to run the service. Respect the people around you: some places require everyone’s consent to record.

4. Films

Films are made from footage camera owners return for you. They’re private by default. Sharing one publicly requires bystander blur, and the camera owner may hold copyright in the footage.

5. Listings, storage and commissions

Paid listings, storage and commissions are processed by Stripe under its terms. Unless stated otherwise or required by law, payments are non-refundable. Artists paid for commissions are paid through Stripe Connect.

6. Acceptable use

Don’t break the law, infringe others’ rights, harass anyone, upload what you don’t have rights to, or try to get around presence rules or access controls. We may remove content or suspend accounts that do.

7. Camera owners

The owner portal is free. Answering through it creates a record of what you sent and when.

8. Disclaimers and liability

The service is provided as is. To the extent the law allows, we aren’t liable for indirect or consequential damages, and our total liability is limited to what you paid us in the past 12 months or US $100, whichever is greater.

9. Changes and law

We’ll update the date below and give notice of material changes. California law governs these terms.
